Katfam Photo Limit of Liability and Copyright Indemnification Agreement

Katfam Photo, located at 847 Edgell Road, Framingham, MA 01701, is committed to preserving your cherished memories through professional digitization services. This Limit of Liability and Copyright Indemnification Agreement outlines the terms under which we provide our services and the responsibilities you assume when submitting materials to us.
Limit of Liability
By submitting any tangible or electronic media (e.g., photos, slides, negatives, films, discs, or digital files) to Katfam Photo for digitization, scanning, printing, restoration, or other services, you agree to the following terms:
No Liability for Loss or Damage
Katfam Photo, its subsidiaries, agents, employees, or affiliates, assumes no liability for any loss, damage, or delay to your materials, whether caused by fire, theft, negligence, shipping issues, or any other cause. This includes materials submitted with orders (e.g., photos, frames, or artwork). You acknowledge that submitting materials is at your own risk, and no compensation or recovery is available for any loss or damage, including incidental, consequential, punitive, or indirect damages.
Service Provided “As Is”
Our services are provided “as is” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, accuracy, or fitness for a particular purpose. In the unlikely event of a misplaced, lost, or damaged order, Katfam Photo is not liable, and no compensation will be provided. At our discretion, we may offer store credit up to the amount of the disputed transaction, but no additional remedies are warranted.
High-Speed Scanning Limitations
Our high-speed photo scanning service is designed to digitally preserve standard photos, not to archive professional or museum-quality images. Due to the high-volume nature of this service, individual quality control or specific image quality guarantees cannot be provided. No refunds are available for high-speed scanning services.
Shipping Risks
You understand that shipping materials to or from Katfam Photo carries inherent risks, regardless of the courier or delivery service used. Katfam Photo is not liable for loss or damage during transit, and you agree not to hold us responsible for such incidents.
Non-Refundable Services
All sales are final once services are ordered. No cancellations or refunds are permitted. Materials or orders unclaimed for more than 30 days after service completion may be disposed of, and Katfam Photo assumes no liability for such materials. Prices and service specifications are subject to change without notice.
Customer Responsibility
You are responsible for verifying the quantity of media submitted (e.g., photos, slides, or negatives) and agree to pay for all media processed. Since our founding, Katfam Photo has strived to deliver exceptional service and protect your orders, but we cannot guarantee the safety or arrival of your materials.
Copyright Indemnification Agreement
Katfam Photo respects intellectual property rights and complies with federal copyright laws. By submitting any materials to us, you agree to the following terms:
Copyright Compliance
You must own the copyright or have explicit permission from the copyright holder to submit materials for scanning, duplication, restoration, or other services. Do not submit copyrighted materials (e.g., photos marked with a copyright symbol © or otherwise protected) without proper authorization. If you are unsure about the copyright status of your materials, err on the side of caution and refrain from submitting them.
Your Responsibility
By submitting an order, you represent and warrant that:
You are the copyright owner of the materials, or you have obtained a valid, signed release from the copyright holder authorizing Katfam Photo to process the materials.
You grant Katfam Photo full permission to scan, duplicate, restore, print, or otherwise process the materials as requested.
You are solely responsible for any legal disputes arising from the submission of copyrighted materials.
Indemnification
You agree to indemnify, defend, and hold harmless Katfam Photo, its employees, directors, agents, and affiliates from any claims, damages, liabilities, or expenses (including reasonable attorney fees) arising from our processing of your materials, including claims by third parties asserting copyright or other interests in the materials. This includes any violations of copyright law, negligence, or breach of this agreement.
No Liability for Copyright Violations
Katfam Photo will not knowingly process copyrighted materials without proper authorization. However, we rely on your representation that you have the necessary rights or permissions. You agree to bear all costs and legal consequences related to any copyright disputes.
Payment for Services
You agree to pay all agreed-upon charges for services provided by Katfam Photo. By submitting an order, you authorize us to perform the requested services and acknowledge that you are responsible for ensuring compliance with copyright laws.
